1. Description of Service
simulation.chat is an AI-powered conversation simulation platform that allows users to:
- Upload chat exports from messaging platforms
- Create alternate conversation scenarios and timelines
- Generate AI-powered dialogue continuations
- Explore hypothetical social interactions
The service uses end-to-end encryption to protect your data. All conversation content is encrypted on your device before being transmitted to our servers.
2. Account Registration
To use simulation.chat, you must:
- Be at least 13 years of age (or the minimum age in your jurisdiction)
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
You are responsible for all activities that occur under your account.
2.1 Recovery Phrase
Critical: Upon account creation, you will receive a recovery phrase (mnemonic). This phrase is essential for recovering your encryption keys and accessing your data across devices.
For ease of use during onboarding, your encryption key is temporarily backed up on our servers (within a hardware-isolated environment) until you authenticate a second device, at which point it is automatically deleted. You can disable or re-enable this backup at any time in your settings.
Once the backup is removed, your recovery phrase becomes the sole method to recover your keys. We do not store your recovery phrase. If you lose it after the backup is disabled, your encrypted data cannot be recovered.
3. Acceptable Use
You agree to use simulation.chat only for lawful purposes. You may NOT use the service to:
- Harass or harm others: Create simulations intended to harass, threaten, defame, or harm any person
- Impersonate maliciously: Generate content to deceive others about the identity or statements of real people
- Upload without consent: Upload private conversations without the consent of all participants, where required by law
- Create illegal content: Generate content that violates any applicable laws or regulations
- Exploit minors: Create any content involving or depicting minors in inappropriate situations
- Distribute malware: Upload files containing viruses or malicious code
- Circumvent security: Attempt to bypass, disable, or interfere with security features
- Abuse the service: Use automated systems to overload or disrupt our infrastructure
4. User Content
4.1 Your Content
You retain ownership of all content you upload to simulation.chat, including chat exports and any original text you create. By uploading content, you grant us a limited license to:
- Store your encrypted content on our servers
- Process your content to provide the simulation services
- Create backups for data integrity purposes
Your content is encrypted on your device and decrypted only within isolated AWS Nitro Enclaves for processing. We maintain strict access controls and governance policies to protect your data.
4.2 Responsibility for Content
You are solely responsible for:
- Ensuring you have the right to upload any content
- Obtaining necessary consents from conversation participants
- The accuracy and legality of content you upload
5. AI-Generated Content
Important Disclaimer
AI-generated simulations are entirely fictional. They do not represent:
- The actual thoughts, opinions, or statements of any real person
- Predictions of what real people would say or do
- Factually accurate information
- Professional advice of any kind
Simulations are creative explorations based on patterns in language. They should never be used as evidence of what someone said, believed, or would say.
5.1 No Guarantee of Accuracy
AI-generated content may contain errors, inconsistencies, biases, or inappropriate material. We do not guarantee that generated content will be accurate, appropriate, or suitable for any particular purpose.
5.2 Use at Your Own Risk
You use AI-generated content at your own risk. Do not rely on simulations for important decisions, and do not present AI-generated content as authentic communications from real people.
6. Intellectual Property
6.1 Our Intellectual Property
simulation.chat and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of our service without explicit permission.
6.2 Feedback
If you provide feedback, suggestions, or ideas about our service, you grant us the right to use such feedback without restriction or compensation to you.
7. Privacy
Your use of simulation.chat is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Please review the Privacy Policy carefully.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the service. We may:
- Modify, suspend, or discontinue features at any time
- Perform maintenance that temporarily affects availability
- Limit access during high-demand periods
We will make reasonable efforts to notify users of significant changes or planned downtime.
9. Termination
9.1 Termination by You
You may delete your account at any time through your account settings. Upon deletion, your data will be permanently removed within 30 days.
9.2 Termination by Us
We may suspend or terminate your access to the service if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Create risk or legal exposure for us
- Fail to pay applicable fees (if any)
We will provide notice before termination when reasonably possible, unless immediate termination is necessary for security or legal reasons.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability for any claims arising from your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater
- We are not liable for loss of data due to lost recovery phrases. While a temporary key backup may be available during onboarding, once removed (automatically after two devices are linked, or manually by you), data recovery requires your recovery phrase
12. Indemnification
You agree to indemnify and hold harmless simulation.chat and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the service
- Your violation of these Terms
- Your violation of any rights of another party
- Content you upload or generate using the service
13. Dispute Resolution
Any disputes arising from these Terms or your use of the service will be resolved through:
- Informal negotiation: Contact us first to attempt to resolve the dispute
- Binding arbitration: If negotiation fails, disputes will be resolved through binding arbitration
You agree to waive any right to participate in class action lawsuits or class-wide arbitration.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which our company is incorporated, without regard to conflict of law principles.
15. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting a notice on our website or sending you an email at least 30 days before the changes take effect. Your continued use of the service after changes become effective constitutes acceptance of the new Terms.
16. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and simulation.chat regarding the service
- Severability: If any provision is found unenforceable, the remaining provisions will continue in effect
- Waiver: Our failure to enforce any right does not constitute a waiver of that right
- Assignment: You may not assign your rights under these Terms without our consent
